摘 要

本文讨论的“知假买假”是指购买明知为假冒、不合格的产品，并以此请求惩罚性赔偿的行为。对于“知假买假”是否予以支持的问题，无论是在工商行政管理实务还是司法审判实践中都存在争议。随着2013年12月23日《最高人民法院关于审理食品药品纠纷案件适用法律若干问题的规定》的发布，不少同仁认为，从此对“知假买假”是否支持的问题不再有疑问，似乎司法有了统一审判尺度，工商部门也有了明确的执法指向。对此，笔者不敢苟同，并认为对“知假买假”行为应分类剖析、分类应对。

ABSTRACT

   "Fake fake" discussed in this article refers to the buying knowing for counterfeit and substandard products, and to request the behavior of the punitive damages."Fake fake" for the question of whether or not to support, in both the industrial and commercial administrative practice and judicial practice are controversial.As on December 23, 2013, the supreme people's court about the food and drug disputes provisions on some issues of applicable law, a lot of my colleagues think, from now on to "know the fake fake" the question of whether or not to support is no longer in doubt, seemed to have a unified judicial trial, the ministry of commerce and industry also had definite law enforcement.To this, I can't agree, and that should be classified to "know the fake fake" behavior analysis, classification.
